Real estate: Easement fight is far from over

The picketing in Saguaro Ranch, the northwest-side luxury development tucked into the Tortolita Mountains that’s now in bankruptcy court, has come to an end.

At least for now.

A civil lawsuit filed by protester Steven Blomquist against Marana was dismissed last week. Until recently, Blomquist regularly picketed over his opposition to the town’s abandonment of a public easement in the development.

The legal battle over the easement has persisted since Marana abandoned it in May 2009. Nearby residents sued the town, arguing the utility road should be kept open to the public for walking and bicycling.

BofA unit focus of Utah foreclosure lawsuit

The Utah Attorney General’s Office says the entity responsible for 4,000 home foreclosures yearly in the state is violating the law.

In a filing with the 10th Circuit Court of Appeals in Denver, Assistant Attorney General Jerrold Jensen said the ReconTrust Co., a unit of Bank of America, is not allowed under Utah law to conduct foreclosure sales.

The brief signals the first substantive effort of the Utah Attorney General Mark Shurtleff to weigh in on legal issues surrounding thousands of foreclosures in Utah. A
